Katy Perry Loses 'Dark Horse' Copyright Trial A jury has found Katy Perry liable for copying the underlying beat of Marcus Gray’s 2008 Christian rap song “Joyful Noise” for her hit single “Dark Horse” in a verdict handed down on Monday (July 29) in Los Angeles federal court. Also found liable were Perry’s “Dark Horse” collaborators Lukasz Gottwald (Dr. Luke), Karl Martin Sandberg (Max Martin), Henry Walter (Cirkut), songwriter Sarah Hudson and Jordan Michael Houston (Juicy J), as well as Capitol Records, Warner Bros. Music Corporation, Kobalt Publishing and Kasz Money Inc. Perry and her collaborators were sued in 2014 by Gray (aka Flame), who claimed they had used the beat from his 2008 track “Joyful Noise” in “Dark Horse” without permission. Chike Ojukwu, who created the beat, and co-writer Emanuel Lambert were also plaintiffs in the case. After a trial lasting seven days, the jury of six women and three men ultimately decided in favor of the plaintiffs, who set out to prove that Perry and her co-defendants had -- either knowingly or unknowingly -- copied the “Joyful Noise” beat for “Dark Horse.” Judge Christina A. Snyder had previously granted a joint request for a bifurcated trial, with today’s judgment concluding the liability portion. The damages portion of the trial will begin Tuesday. Today’s outcome follows a landmark 2015 decision in the trial over Robin Thicke’s “Blurred Lines,” in which a jury ordered Thicke and his co-writer/producer Pharrell Williams to pay a combined $7.4 million to the estate of late soul singer Marvin Gaye for infringing the copyright of Gaye’s 1977 song “Got to Give It Up.” In March 2018, the Ninth Circuit Court of Appeals upheld the district court ruling, which was largely seen as setting a precedent for future copyright infringement lawsuits, few of which ever make it to trial and many of which are settled out of court. Like “Blurred Lines,” “Dark Horse” also proved to be a hugely popular pop hit, reaching No. 1 on the Billboard Hot 100 in 2014. One of the main differences between the two cases was the availability of the plaintiffs’ songs; while “Got to Give It Up” was a massive hit that went on to become one of the best-known songs in the legendary Gaye’s discography, “Joyful Noise” was a Christian rap song that, while apparently popular with Christian audiences (it had nearly 5 million views combined on YouTube and MySpace, and the album on which it appeared, Our World Redeemed, was nominated for a Grammy), never enjoyed significant mainstream popularity. That lack of availability was a core argument of the defense, with Perry, Dr. Luke and co-writer Max Martin all testifying that they had never heard “Joyful Noise” prior to being sued and defense lawyers arguing that out of trillions of YouTube views between 2008 and 2012, the “Dark Horse” writers were highly unlikely to have come across Gray’s religious-themed track. They also argued that because Ojukwu created the beat independently and later licensed it to Gray, “Joyful Noise” itself was a derivative work and that the plaintiffs therefore had no legitimate copyright claim to the beat on its own. On the plaintiffs’ side, Gray, co-plaintiffs Lambert and Ojukwu and Gray’s wife and manager Crystal Gray all took the stand, along with musicologist Todd Decker, who independently determined that Perry and her co-defendants had “borrowed” the beat from “Joyful Noise.” Defendants countered that testimony with their own expert, New York University musicologist Lawrence Ferrara, who said that “Dark Horse” wasn’t substantially similar to Gray’s song and that it contained basic elements common across countless other tunes, including such staples as “Mary Had a Little Lamb,” “Jolly Old St. Nicholas” and “Merrily We Roll Along.” Another angle employed by the plaintiffs was establishing Perry’s short-lived career as a Christian pop singer in the early 2000s and her background as the child of two pastors -- the implication being that she may have been more predisposed to have come across “Joyful Noise” because of her history. But Perry testified that she was “mostly always listening to ... secular music anyway,” even during the Christian-pop phase of her career.   5. Disney Announces Beyonce-Produced 'The Lion King: The Gift' Album Walt Disney announced on Tuesday (July 9) that Beyonce will be curating and producing a new album, The Lion King: The Gift. The album and the film's soundtrack will also include new Bey song called “Spirit,” out tonight. The album will feature a number of global recording artists and "steeped in the sounds of Africa," according to the announcement on Instagram. “This is sonic cinema,” Beyoncé said of the record in a statement. “This is a new experience of storytelling. I wanted to do more than find a collection of songs that were inspired by the film. It is a mixture of genres and collaboration that isn’t one sound. All those efforts add up to a $600 million fortune, making her the wealthiest female musician in the world, ahead of the likes of Madonna ($570 million), Céline Dion ($450 million) and Beyoncé ($400 million). Many did what Rihanna did, turn to the low-cost marketing opportunity presented by social media. That works best for existing celebrities, as Kylie Jenner and her Kylie Cosmetics proved out, who can push their new products at their existing followers. Fenty Beauty has differentiated itself in another way, releasing 40 shades of foundation, far more than the handful of hues sold by other brands. “It challenged the standard convention that you only needed a very defined set of shades to satisfy a market,” says Stephanie Wissink, a research analyst at Jefferies. “Not only did [Fenty Beauty] achieve meaningful sales, but it potentially changed the industry permanently.” Sales continue to soar. Fenty Beauty generated an estimated $570 million in revenue last year, after only 15 months in business. The entire operation is worth, conservatively, more than $3 billion. The Barbados native, who overcame hardships including an abusive addict father and a well-publicized assault by then-boyfriend Chris Brown in 2009, also co-owns the Savage X Fenty lingerie line with Los Angeles-based online fashion firm TechStyle Fashion Group and has millions in earnings from her career touring and releasing as a singer, which make up the rest of her fortune.   18. Review: Ariana Grande at Coachella was not the pop star we needed Oh no. Does this mean we’re in for a few years of washed-up guitar bands? When Coachella announced in January that it had booked Ariana Grande as one of its headliners, many old-time festival-goers expressed sorrow that their precious alternative-rock show — the desert blowout that once hosted the likes of Nine Inch Nails and Rage Against the Machine — had gone fully and irredeemably pop. I was optimistic: As savvy a superstar as the top 40 can claim right now, Grande in my view is perfectly capable of designing a Coachella set to bridge the gap between the festival’s dark-and-edgy past and its bright-and-shiny present. And given how good she is on “Thank U, Next” — the album she released after Coachella revealed its lineup — I still believe she could’ve done it. But the disappointing show Grande played Sunday night to close the first weekend of this year’s edition — well, that wasn’t it. The performance started strong, with the singer belting “God Is a Woman” amid a Last Supper-style tableau; next was “Bad Idea,” which had her dancers writhing as profanely as any NIN fan could want. Then she sang a tart rendition of “Break Up with Your Girlfriend, I’m Bored,” a song that samples an old track by ’N Sync. As had been widely rumored before showtime, that was a pretext to bring out four members of the beloved boy band — all of them but Justin Timberlake — who enlisted Grande to join them for their classic “Tearin’ Up My Heart.” “I’ve been rehearsing my whole … life for this,” Grande said, using a salty adjective, and though she didn’t say it, you could tell how much she was enjoying playing Timberlake’s part after he reportedly bowed out of doing Coachella, which opened the spot up for her. Pretty clever. Unfortunately, the show began to fall apart after that. Grande’s singing was fine, at least when she bothered to sing. (She relied on a lot of vocal tracks.) And her costumes were fun. But with routines from her current arena tour jammed together with special-for-Coachella numbers, this thing told no coherent story — a must for any pop extravaganza that plays in the wake of Beyoncé’s game-changing performance last year. Worse, the would-be show-stoppers (other than the collaboration with ’N Sync) were sloppy as hell. Nicki Minaj turned up to do her verses in “Side to Side” and “Bang Bang,” but rapped so carelessly that it came as no surprise when she didn’t come out later during “The Light Is Coming,” on which she also features. And though you had to appreciate the thought that went into it, an unannounced appearance by Diddy and Mase to do “Mo Money Mo Problems” — which Grande sampled years ago for her own “Break Your Heart Right Back” — went sideways when the singer’s band seemed unable to settle on a key for the song. Which meant that the moment, lacking any musical value, registered only as hollow spectacle — precisely the thing that diehard rock chauvinists say Coachella was indulging by booking a pop star in the first place.
